Can a finalized divorce be voided if the wife knowingly did not tell the judge about being pregnant?
A.L. asked:
Couple of divorce lawyers said divorce can not be finalized while the wife is pregnant. So a friend of mine’s wife did not tell the judge she is pregnant in order for the divorce to be finalized. Can the divorce be void if the count find out but it’s already finalized? Can she be in any trouble? This case is in the state of Ohio.

I am in the UK and it doesn’t matter if the woman is pregnant or not when she files for divorce so unless the law is different over there I cant tell you, seems a strange situation though to have to stay married just because you are pregnant. Wouldn’t suit me at all, if its over its over.

As long as the ex does not fight it, I don’t see and issue.

What does being pregnant have to do with a divorce being finalized? Their divorce is legal.

Don’t know about Ohio but in Mississippi you can’t get divorced until the baby is born.

If the courts find out, they may take some action or at least review the divorce case and document that there is a pregancy, could change the settlement agreement issues when a child is involved with parenting issues

A.L., I got divorced last fall, so I know a little bit about the divorce process. For the most part my lawyer helped take care of most of my questions. The rules and regulations are most likely different in Ohio than South Carolina (where I used to live) so I don’t want to give you bad advice. Try contacting a Ohio divorce lawyer for help.
